Terms and Conditions of Sale
PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALE AGREEMENT") VERY CAREFULLY. THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS.
This Sale Agreement constitutes the entire agreement between the CUSTOMER and SMC Australia relating to the purchase, placing an order, or sale of goods or services on the Site. In the event of any conflict between the terms and conditions stated on the purchase order and this Sale Agreement or any terms and conditions on our invoice, SMC Australia reserves the right to make final adjustments.
2. Information Disclaimer
For all prices, products and offers, SMC Australia reserves the right to make adjustments without notice due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. All SMC Australia decisions are final and binding.
3. Terms of Payment
Terms of payment are within SMC Australia sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. If CUSTOMER does not meet the deadline for payment or if payment is deferred, SMC Australia reserves the right to charge interest staring from the original deadline for a payment. The interest is set at 5% above the base rate of NAB Bank from time to time until payment in full is made such interest being calculated on a daily basis. The CUSTOMER is responsible for sales and all other taxes associated with the order.
4. Return Policy
SMC Australia does not offer any refunds under any circumstances. CUSTOMER shall contact the original point-of-purchase for their return/refund policy. CUSTOMER must complete the SMC Australia RA Form including a written description of the product defect in sufficient detail submitted with the product to allow SMC Australia to confirm the same.
Products for return will only be accepted with a Return Authorization (RA) number offered by SMC Australia and the RA number is strictly valid for a period of 30 days from the day of issue. SMC Australia RA has a repair process; and will replace the product under certain circumstances where SMC Australia RA technician are unable to solve the fault. All products sold by SMC Australia are third party products and are subject to the warranties and representations of the applicable manufacturers. SMC Australia provides this Limited warranty for its product only to the person or entity that originally purchased the product from SMC Australia or its authorized reseller in Australia.
SMC Australia warrants its products to be free from defects in workmanship and materials, under normal use and service, from the date of purchase from SMC Australia or its Authorised Resellers in Australia.
6. Limitation of liability
SMC Australia does not accept any liability for any direct, indirect, special, consequential, punitive loss or damages suffered by CUSTOMER as a result of use of any of our products. All products are supplied "as is" and should be installed and tested (before installation) by a professional. Failure to have items installed by a professional may void the products warranty if they are in any way incorrectly installed.
7. Governing Law
This Sale Agreement is governed by the laws of the State of New South Wales, Australia. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN NEW SOUTH WALES, AUSTRALIA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.
